UPDATE: Attorney says cell phone not blamed for crash

UPDATE (2 p.m.) Attorney David Aylor says Rupley has fully cooperated with police who have ruled out use of a cell phone or texting at the time of the accident. Aylor says his client is very saddened by the doctor's death.

PREVIOUS: It's been just over a week since cycling enthusiast Dr. Mitchell Hollon was killed while he rode his bike on the James Island connector.

Dr. Hollon was thrown from his bicycle and landed in the marsh nearly 40 feet below.

Wednesday the driver of the vehicle that struck Hollon was charged: here is the statement released by the Charleston City police department.

"After careful consideration of all the evidence and facts gathered concerning this collision, investigators with the Charleston Police Department’s Traffic Division have charged Gregory E. Rupley with Improper Lane Usage. "

The investigators consulted with the Solicitors Office regarding this charge.

 The court date for the driver, Gregory Rupley, is scheduled in Municipal Traffic Court on 9/1/2011.
